1. This addendum (the “UA Addendum”) modifies our User Agreement here and applies to non-EEA and Swiss readers and subscribers of the website www.lacucinaitaliana.com (“Website”). All capitalized terms used in this UA Addendum that are not defined herein are defined in the User Agreement.
2. The Website and PRODUCTS: The Website and Products are made available by Edizioni Condé Nast S.p.A. (“Condé Nast”), with registered office in Piazzale Luigi Cadorna 5, Milan, Italy, VAT number 00834980153. Notwithstanding Section VIII(6)(A) of the User Agreement, the Website and the Products are based in Italy.
3. User Subscription: Notwithstanding Section V(A) of the User Agreement, subscribing to the Website and/or using the Products is permitted only to adult users or underage users who are at least 16 years of age. Users who are below 16 years of age are expressly prohibited from providing their personal data and from using any part or section of the Website or the Products. No information provided by such users shall be knowingly used, placed online or stored. Users under 16 years of age must obtain the consent of their parents or guardians, and use the Website and the Products through them, who in turn must have duly subscribed to the Website.
Notwithstanding Section III(1)(F) of the User Agreement, you undertake to promptly report any unauthorized use of your username and/or password and/or any other security violation of the Website of which you become aware through the following e-mail address privacy@condenast.it. The same applies for cases listed under Section III(1)(B) of the User Agreement.
You are entitled to withdraw from the User Agreement and this UA Addendum at any time by unsubscribing from the Website and deleting your account or by notifying Condé Nast via e-mail at privacy@condenast.it and specifying the type of deletion you are requesting.
Notwithstanding Section VI(3) of the User Agreement, if you unsubscribe from the Website or you ask for the Products to be cancelled, any Content you have published on the Website, will not be removed automatically, but will remain online without being attributed to you. You can request that the Content you have published be removed by sending an e-mail to: privacy@condenast.it. The same applies to the cases listed under Section VIII(3)(B) of the User Agreement.
According to Sections VI(4) (C) and (E) of the User Agreement, if you have reason to believe that your Content has been copied and/or is accessible on the Website in a way that constitutes copyright infringement, or that the Website contains links or other references to another site, application, destination or service that contains Content or activity that infringes your copyright rights, you may notify us by providing a document via fax, first class U.S. mail, or e-mail to: Edizioni Condé Nast S.p.A., Piazzale Luigi Cadorna 5, 20123 Milan, Italy, fax 028055716, e.mail: info@lacucinaitaliana.com.
4. Indemnification: To extent permitted by applicable law, Section VIII(1) of the User Agreement applies also to any and all Claims which may arise out of or are in any way connected with the provision of the Website or Products, as well as your violation of any applicable law or third-party rights.
5. Limitations and changes to the Website and the Products: Condè Nast will make reasonable efforts to keep the Website and the Products operating. However, certain technical difficulties, maintenance or the need to carry out tests, or the updates necessary to implement changes in applicable laws or regulatory requirements, may, from time to time, result in temporary interruptions of the Website or the Products. Condè Nast reserves the right - periodically and at any time - to modify or interrupt, temporarily or permanently, the functions or features of the Website and the Products pursuant to Section VIII(3)(A) of the User Agreement for good reasons such as system or line interference or disruption, necessary modifications or suspensions of the Website or the Products or any related function or feature thereof, any need for repair, maintenance or improvements to existing functions or features, addition of new functions or features to the Website or Products, implementing advancements in the scientific and technological field, ensuring operability or security of the Website and the Products, as well as for legal or regulatory reasons. In such cases, Condé Nast shall inform users in advance, where possible and appropriate according to the circumstances (for example by showing communications in a visible position on the Website or by sending a communication).
6. Limitation of Liability: Sections 8(2) of the User Agreement shall apply to the maximum extent permitted by applicable law. You agree that your sole and exclusive remedy for any problems or dissatisfaction related to the Website or the Products is to unsubscribe from the Website and to stop using the Products. You may be entitled to additional rights pursuant to mandatory rules of your country.
7. GOVERNING LAW AND JURISDICTION: Notwithstanding Section VIII(6)(I) of the User Agreement, this UA Addendum and the provision of the Products shall be governed and interpreted according to Italian law. Any dispute that may derive from the relationship governed by this UA Addendum shall be subject to the exclusive jurisdiction of the Court of Milan, unless you are an EU consumer, in which case the jurisdiction shall be established according to the relevant EU law, as well as your national law, on consumer rights. Finally, you hereby expressly accept, pursuant to Articles 1341 and 1342 of the Italian Civil Code, the following articles of this UA Addendum: 4) Indemnification; 5) Modifications to the User Agreement or New Terms; 6) Limitations and Changes to the Website and the Products; 7) Limitation of liability; and 8) Governing law and jurisdiction.
8. Further Derogations to the User Agreement: The arbitration and dispute resolution clauses envisioned under Section I and Section VIII(6)(D) and (E) of the User Agreement do not apply to the readers and subscribers of the Website. All other terms and conditions of the User Agreement shall remain in effect and unchanged to the maximum extent permitted by applicable law. In the event of a conflict between the terms of the User Agreement and the terms of this UA Addendum, the terms of this UA Addendum shall prevail and control.
